General Terms and Conditions (GTC)

for CREABLE.STUDIO

1. Scope of Application

These Terms and Conditions apply to all orders you place through my online shop.

Any differing terms and conditions you may have will not be recognized unless I expressly agree to them in writing.

2. Contracting Party

The purchase agreement is concluded with:

3. Contract Conclusion

As soon as you select a product in the shop and complete the order process by clicking the "Buy" or "Place Order" button, you submit a binding offer to purchase.

I will confirm receipt of your order by email. The contract is concluded upon receipt of this confirmation.

If you would like individual personalization (e.g., names, engravings, your own designs), production will only begin after receipt of payment and approval of the design.

4. Prices & Shipping Costs

All prices are final prices and include statutory VAT (where applicable).

Shipping costs are added – unless otherwise stated – and will be displayed to you before you complete your order.

5. Payment

You can pay using the payment methods specified in the shop (e.g., PayPal, credit card, prepayment, or other payment services).

In the case of prepayment, production and/or shipping will only commence after receipt of payment.

6. Delivery

I will deliver to the address you provided.

Delivery time depends on the type of product and current order volume.

For personalized items, the delivery time begins only after the individual order has been completed.

7. Right of Withdrawal

You have the right to withdraw from your order within 14 days without giving any reason.

You can find the exact details in my cancellation policy below.

8. No Right of Withdrawal for Personalized Products

Please note:

There is no right of withdrawal for custom-made or personalized products (§ 312g para. 2 no. 1 of the German Civil Code).

This applies, for example, to products with names, engravings, your own texts, photos, or colors that you have selected yourself.

Once I begin production, the order can no longer be canceled or returned.

If your order contains both standard and personalized items, this exclusion applies only to the personalized products.

9. Retention of Title

The goods remain my property until full payment has been received.

10. Warranty

The statutory warranty rights apply.

Please contact me promptly if you experience any problems or defects – we will certainly find a solution.

11. Liability

I am liable only for damages resulting from intentional or grossly negligent conduct.

In cases of simple negligence, I am liable only if essential contractual obligations have been breached.

This limitation of liability does not apply to damages resulting from injury to life, body, or health.

12. Data Protection

Your personal data will be processed exclusively in accordance with legal regulations.

13. Dispute Resolution

I am neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

However, you can contact me directly at any time if you have any problems.

14. Final Provisions

Should any provision of these Terms and Conditions be invalid, the remainder of the contract shall remain in effect.

The laws of the Federal Republic of Germany shall apply.

If you place your order as a consumer and your habitual residence is in another EU country, the mandatory consumer protection regulations of that country shall also apply.

15. Use of Product Images for Marketing Purposes

I reserve the right to photograph or film the products I manufacture for marketing and advertising purposes and to use this content (e.g., on my website, in social media, or in advertising materials).

I ensure that:

• no personal data of yours is published and

• personalized content (e.g., names, personal texts, or photos) is only displayed anonymously or in a way that obscures your identity, unless you explicitly consent otherwise.

If you do not wish for your product to be used for marketing purposes, you can object at any time – ideally by sending a brief email.

In this case, I will, of course, not use your product for advertising purposes.
